Sub: Commercial Utilisation for display of advertisement by fixing Kiosks on HT/LT poles, Sub-station structures, fencing etc.
The HT & LT poles, various sub-station structures and also the fencing of plinth mounted transformers can be very effectively used for advertisement purposes by outside agency. It has been decided to lease out these structures for fixing of Kiosks for displaying advertisements to outside agencies. It is also decided that these lease arrangement shall be done through a transparent contract mechanism after inviting area-wise tenders.
This decision has been taken to mop up additional revenue for our Company and the same is also now notified in tariff regulations covered under "income from other sources".
The Superintending Engineers of O&M Circle will be the main co-ordinating officer for this tender process for various Gram Panchayats, Municipal Councils, Municipalities and Municipal areas under their respective Circles. In case of areas covered under Bhandup Urban, Pune Urban, Kalyan Urban and Nagpur Urban the concerned Chief Engineer will be the co-ordinating officer for this tender process.
There should be a separate tender for all the Corporation areas in respective circles.
The following points are to be incorporated in the tender document. This shall be treated as mandatory terms and conditions of the tender.
The contractual period will be one year from the date of award of contract which can be extended by one more year. The extension however, will be at the sole discretion of MSEDCL.
This contract is of lease agreement for advertisement purpose on MSEDCL's structure.
The contractor shall quote the rate as under:
Rate per kiosk and per role (one pole can also have two or more kiosks).
If the same contractor is quoting for various areas in the same circle there should be separate rate for Gram Panchayats, Municipal Councils, Municipalities and Municipal areas.
The contractor shall quote the minimum guarantee amount for one year apart from the lease rent per kiosk and lease rent per pole.
This minimum guarantee amount shall be payable irrespective of the fact whether the contractor installs the kiosks on the poles or otherwise.
In case the lease rent is more than the minimum guarantee amount, then higher rate will be payable by the contractor.
The minimum guarantee amount is required to be paid which shall be equivalent to the annual minimum guarantee of one year. This amount is to be paid through an unconditional Bank Guarantee (Nationalised Banks) in favour of MSEDCL encashable at par at the sole instructions of MSEDCL.
In case of difference between minimum guarantee amount and the rates quoted on the basis of per kiosk per pole the same shall be paid immediately with the bill for this differential amount is raised by MSEDCL. This amount shall be payable within 7 days from the date of raising of this bill. In case of failure to pay in seven days time, the Bank Guarantee shall stand to be encashed.
The size of the kiosk has been standarised as 2' x 3' (width x height).
The kiosks shall be installed in such a way that the bottom edge of the same is not more than 6' from the ground level.
The contractor shall intimate area-wise structures (HT/LT poles, sub-station structures, fencing, etc.) where he intends to install the kiosk and also take prior written permission of MSEDCL officers before fixing the same.
All the amounts of the guarantee money or the lease rent whichever is higher shall be paid in advance before start of the each quarter.
The work of installation of kiosk shall be done under the supervision of MSEDCL authorised personnel.
While fixing these kiosks, the contractor shall undertake to ensure that all safety precautions are complied. The safety norms as stipulated in various rules and regulations and also notified by different statutory authorities should be strictly adhered to by the contractor. MSEDCL will not be responsible for any loss to the property or life during this contractual period.
The contractor will have to submit a indemnity bond covering the aspect of safety precautions by clearly indemnifying MSEDCL from any statutory or non-statutory claims.
The contractor will be responsible and be liable to pay for the amount in case property of MSEDCL is damaged while fixing of kiosks.
No electricity supply will be provided to these kiosks under any circumstances.
All the acts and statutory provisions covering this advertisement and kiosk shall be strictly adhered to by the contractor and will be his sole responsibility. The contractor will be required to indemnify MSEDCL against any damages or claims for non-compliance of any of the statutory provisions.
The legal jurisdiction for this contract shall the competent courts within the State of Maharashtra only.
