Sub: Appointment of retired Officers of the rank of Ex.Engineer,
Dy.CAO, Dy.E.O. equivalent and above as Enquiry Officers.
1. In accordance with the Admn.Circular No.313 dt.18/5/99 read with Admn. Circular No.455 dt.8/4/2005, the Board has accorded approval to appoint the retired officers of the rank of EEs, Dy.CAOs, Dy.EOs, equivalent and above as Enquiry Officers for conducting the departmental enquiries and to pay the fees of Rs.5000/- (inclusive of all charges) per case and to grant TA/DA on par with Board’s equivalent officers for conducting the enquiries. However, it is now decided that the retired officer shall not be entitled for Air Fare or Air Conditioned First Class Railway Fare.
2. The Board has also directed to prepare a panel of retired officers who were having impeccable integrity while in service of the Board. Accordingly, list of retired officers has been drawn for empanelment and attached herewith for appointing them as Enquiry Officers. The list is sorted on name as well as place of present residence of retired officer to facilitate field offices.
3. Though the place of present residence of retired officer is shown in empanelled list, the Competent Authority is permitted to select any officer from any of the place as an Enquiry Officer. The TA/DA expenses may be regulated from the said place or a place within the State of Maharashtra from where such retired officer commenced his journey for conducting the enquiry limited to what would have been payable as for the journey from the place of present residence to the place of enquiry irrespective of the fact that he is retired from any of the place. The place of present residence may be allowed to be changed subsequently within State of Maharashtra for the purpose of regulating TA/DA at the request of retired officer at the sole discretion by the Chief General Manager (Personnel). It will not be obligatory on Company to entertain the request.
4. In case the retired officer is unable to secure accommodation in the Board’s Rest House in the nearby vicinity of the place of enquiry fixed for any reason, then he shall be entitled to the reimbursement of hotel charges limited to the scale of reimbursement notified under Correction Slip No.2 dated 18/6/1993 to G.O.101(P) dated 5/12/1980 on the production of receipts without any deduction on account of Rest House charges. The certificate given by the retired officer about none securing the accommodation with reasons shall be sufficient for admitting the claim of Hotel charges.
5. The directives in para 5 of Admn.Circular No.455 dt.8/4/2005 about assigning enquiries of the employees in T&D cadre to Officers in Generation Cadre and vice versa are hereby withdrawn enabling the Competent Authority to appoint any of the empanelled Officer as an Enquiry Officer irrespective of the Cadre.
6. It is clarified that the fees to be paid is exclusive of stationery, typing, Xeroxing, postage and Fax which will be borne by the Company by way of payment to the concerned service provider/Agency directly or through reimbursement to the retired officer if incurred by him. The payment of fees and other payables shall be arranged by the concerned Competent Authority (viz. the Competent Authority which has assigned the enquiry) on receipt of Enquiry Report with findings. The payment of fees and other payables to Enquiry Officer may be arranged by the concerned Competent Authority within a month from the date of submission of claim by him.
7. The Management Representative has to make arrangement for writer and other clerical arrangements for recording of proceedings including stationery during the enquiry. He shall also make arrangements for Rest House or Conference Room or any other suitable place for sitting and conducting the enquiry and to intimate the Enquiry Officer accordingly on telephone and subsequent confirmation through Fax or letter for enabling him to incorporate the said details while conveying the date fixed for enquiry. The Management Representative may extend facility of vehicle to Enquiry Officer for local movements whenever necessary and feasible. The retired officers appointed as Enquiry Officer shall also be entitled for actual reimbursement of Riksha/Taxi charges at the place of visit limited to Rs.50/- (to & fro) per occasion, if the facility of vehicle could not be extended by the Management Representative.
8. The Management Representative shall ensure that he attends the enquiry well prepared without seeking postponement of enquiry and present Company’s cases during the enquiry, effectively. Letters to the Company’s witness shall be issued by him well in advance no sooner the date & venue is fixed. The Management Representative should also ensure that the enquiry is not postponed for want of proper arrangement to conduct enquiry or for any other reason. The attention of Management Representative is also invited to the instruction of erstwhile Chairman issued vide H.O. Circular No.GAD/EC/General/ 7084 dt. 6/8/1973, for strict compliance.
9. The letter of appointment as an Enquiry Officer may be issued in the usual proforma by the respective Competent Authorities delegated with powers under Schedule ‘C’ to Employees’ Service Regulations. However, before issuing such letter the concerned Competent Authority shall ensure on telephone or fax or any other prevailing mode of communication from such retired officer that he is available for conducting and completing the enquiry within the stipulated period.
10. The general Terms & Conditions for appointing retired Officers as an Enquiry Officer are attached herewith for information of field offices and to regulate their claims.
11. The appointment of Enquiry Officers from the panel can be made upto 31/3/2006. Thereafter revised panel will be notified by the Disciplinary Action Cell, in H.O. with the approval of the Chief General Manager(P), from time to time.
12. This Circular is issued with the approval of Director(Operations), Director(Finance) & M.D. of M.S.E.D.C.L.
